Welcome to InHome, a service operated by DX Daily Store Inc (“DX Daily Store” or “us”).  These terms of use (“Terms of Use”) are between you and Walmart.  Before using the InHome Service, as defined below, please read these Terms of Use, the dxdailystore.com Terms of Use (available here), the W+ Terms of use (available here),  and the other applicable rules, policies, and terms posted by us through the InHome software application (the “InHomeApp”), all of which are incorporated into these Terms of Use by reference (collectively, this “Agreement”).  By using the InHome Service and by responding “I agree” in a website made available to you by DX Daily Store you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use the InHome Service.

We may change, suspend, limit, or discontinue the InHome Service, or any part of it, at any time without notice.  We may amend any of this Agreement’s terms at our sole discretion by posting the revised terms under the terms of use section of dxdailystore.com (listed above) or through the InHomeApp, or by notifying you of such changes by any other reasonable means.  Your continued use of the InHome Service after the effective date of the revised Agreement constitutes your acceptance of the revised terms.

For the purposes of these Terms of Use:

Companion Product” means any other product or device designated by us for use with the WiFi Bridge to access the InHome Service, which may include, for example, smart locks,  garage openers, Grocery Boxes, and all associated software or applications with such Companion Products or devices. Companion Products are included in the InHomeKit for the convenience of users.  Companion Products are provided by a third party and are subject to separate instructions, warranties, software licenses, terms of use, and/or other requirements of the third party. To utilize certain features of Companion Products you may be required to set up a separate account with the third party who manufactured or otherwise provides such Companion Product.

“Companion Product Software” means all third party software included in the Companion Products (including any updates or new versions), solely in object code format, and any related documentation, in each case made available to you by DX Daily Store for your convenience to use in connection with the InHome Service.

Existing Product” means a keypad lock or garage door opener provided by you and not by Walmart.

InHomeKit” means the Wifi Bridge and Companion Products,  or “Grocery Box”and any related documentation purchased or otherwise acquired by you from us in relation to the provision of the InHome Service.

InHome Service” means Walmart’s in-home grocery delivery and return pick up service.

 “InHome Software” means all WiFi Bridge and InHome App software (including any updates or new versions), solely in object code format, and any related documentation, in each case that we make available to you for use in connection with the InHome Service.

Recordings” means any audio, image, video, or other types of recordings made in connection with your use, or the provision to you, of the InHome Service.

“WiFi Bridge” means the Walmart-provided product that when installed allows you to connect to the InHomeApp and to use the InHome Service.

“Grocery Box” means the Walmart-provided product that when installed allows you to connect to the InHome App and to use the InHome service for deliveries made into a refrigerated box outside your home.

1.     Member Accounts. To use the InHome Service, you must be 18 years or older, a Walmart+ member, and register.  To be eligible to create an Account, and to otherwise use the InHome Service, you must be at least 18 years old.  You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all Account activities that occur using your login credentials.  You agree not to allow a third party to use your login credentials at any time.  In order to view your delivery, you must download the inHome App (for an Android or iPhone operating system only).From time to time, you may be required to update your InHome App to use this Account functionality. 

2     InHome Software License; DX Daily Store Intellectual Property Rights. 

     2.1      Limited License.DX Daily Store hereby grants to you a limited, non-exclusive, non-transferable license (without the right to sublicense): (i) to use a single copy of the InHome Software solely for your own personal operations on the equipment on which the InHome Software was first installed for the purpose of receiving the InHome Service or, on a temporary basis, on a backup system if such equipment is inoperative, consistent with the limitations specified or referenced in this Agreement; (ii) to use the documentation provided with the InHome Software in support of your authorized use of the InHome Software; and (iii) to copy the InHome Software for archival or backup purposes, provided that all titles and trademark, copyright and restricted rights notices are reproduced on all such copies.

      2.2      Restrictions. You will not copy or use the InHome Software or Companion Product Software (including any associated documentation) except as expressly permitted by this Agreement.  You will not relicense, sublicense, rent or lease the InHome Software or use the InHome Software for third-party training, commercial time-sharing or service bureau use.  You will not, and will not permit any third party to, reverse engineer, disassemble or decompile any InHome Software, except to the extent expressly permitted by applicable law, and then only after you have notified DX Daily Store in writing of your intended activities, and will strictly adhere to any restrictions applicable to the Companion Product and InHome Software. Additionally, the Wifi Bridge and Companion Products are being provided to you strictly for your personal use in conjunction with the InHome Service.  You may not resell the Wifi Bridge or Companion Products, nor provide them to any third Party.

     2.3      Ownership. As between the parties, DX Daily Store will retain all right, title and interest in and to the patent, copyright, trademark, trade secret and any other intellectual property rights in the InHome Software and any derivative works thereof, subject only to the limited licenses set forth in this Agreement.  You do not acquire any other rights, express or implied, in the InHome Software other than those rights expressly granted under this Agreement.  

    2.4      Grocery Box, Wifi Bridge and InHome App Support. DX Daily Store shall provide maintenance, support, upgrades, modifications or new releases solely with respect to the Grocery Box, Wifi Bridge and InHome App as they may become available and in their sole discretion.

     2.5      Feedback. If you send or transmit any communications or materials to DX Daily Store or any of its Affiliates by mail, email, telephone, via the InHome App, or otherwise, suggesting or recommending changes to the Grocery Box, WiFi Bridge or InHome Software, Companion Products or Companion Product Software or the InHome Service, including without limitation, new features or functionality relating thereto, or any comments, questions, suggestions, or the like (“Feedback”) to DX Daily Store, DX Daily Store and its Affiliates are free to use such Feedback irrespective of any other obligation or limitation between the parties governing such Feedback. You hereby assign to DX Daily Store all right, title, and interest in, and DX Daily Store and its affiliates are free to use, without any attribution or compensation to any party, any ideas, know-how, concepts, techniques, or other intellectual property rights contained in the Feedback, for any purpose whatsoever, although neither DX Daily Store nor its affiliates are required to use any Feedback.

3.     Companion Product Software Restrictions

     3.1      Restrictions. Companion Product Software associated with Companion Products may be subject to third party intellectual property ownership rights and may be subject to separate terms and conditions of use, license agreements, and privacy policies. It is your responsibility to review and adhere to any such restrictions or limitations when you use the Companion Products.

4.       In-Home Delivery

     4.1      Delivery Personnel.  The InHome Service may permit you to enable in-home delivery of groceries, return pickup of certain DX Daily Store products delivery of certain DX Daily Store products at eligible addresses, as may be communicated by you to us from time to time.  At the time of registration, you can choose whether you would like your InHome delivery or return pickup to take place via your front door or via your garage or via the Grocery Box, and the location inside your residence where groceries or return pickups should be deposited (your “Home”). If you make no selection at the time of registration, your InHome delivery will be made to your doorstep. If you would like to make a change to your original selection of location of delivery, please contact customer service as set forth below in Section 11.2. If you place an order for InHome delivery of products via dxdailystore.com through the InHome Serviceor schedule an InHome return pickup of eligible products via dxdailystore.com you are: (i) authorizing DX Daily Store and/or DX Daily Store employees (“Delivery Personnel”) to unlock the smart lock on your front door or use the garage opener to open the garage door and enter your Home, and to access and enter your Home in the manner you designated at registration for the purpose of delivering your order or picking up your return, and (ii) confirming that you have the right to authorize Delivery Personnel to unlock such smart lock or garage door opener and to access and enter your Home. DX Daily Store reserves the right to decline to deliver your products or pickup your return in its sole discretion. 

     4.2     Delivery Personnel Access to Your Home.  You represent and warrant that your Home will be safe and free of any hazards.  To use the InHome Service, you must disarm any alarm or other security service in your Home.  NEITHER DX Daily Store NOR ANY OF ITS AFFILIATES ARE RESPONSIBLE FOR DISARMING OR SUBSEQUENTLY RESETTING ANY SUCH ALARM OR OTHER SERVICE, OR FOR YOUR FAILURE TO DO SO, OR FOR ANY LIABILITY ARISING FROM THE ALARM OR OTHER SECURITY SYSTEM NOT BEING ARMED IN YOUR HOME, HOWEVER CAUSED.   The smart lock and garage opener within the Companion Products are designed to record when your front door or garage door is opened by Delivery Personnel and when your front door or garage door is closed and/or locked by Delivery Personnel.  Currently, the Companion Product smart lock only allows you and the Delivery Personnel to lock and unlock your front door. You may be able to purchase additional functionality for your smart lock (“Upgrade Functionality”) from our third party smart lock provider.  To the extent you purchase the Upgrade Functionality, you understand and agree that DX Daily Store is not responsible for any of the additional features offered by our third party smart lock provider. You will be required to create an account with the third party lock provider to receive the Upgrade Functionality. DX Daily Store has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or service provider. For your convenience, DX Daily Store may offer links to third party providers (i.e. the smart lock provider), through the InHome App. If you access a third party website from the InHome App, you do so at your own risk, and you understand that this Agreement and the DX Daily Store Privacy Policy do not apply to your use of such sites. You expressly relieve DX Daily Store from any and all liability arising from your use of any third-party website or services. We encourage you to be aware of when you leave the InHome App, and to read the terms and conditions, license agreements and privacy policy of any third-party website or service that you visit. You may also be able to use an Existing Product with the InHome Service.  If using an Existing Product, you agree to provide the keypad code for the Existing Product to DX Daily Store to enable the Delivery Personnel to unlock/lock the keypad lock or open/close the garage door using the keypad garage door opener.  You are encouraged to change the keypad code on the Existing Product after the Delivery Personnel has performed the InHome Service.  You acknowledge and agree that the Existing Product may not function with the InHome App and that there may not be a record through the InHome App for any unlocking or locking of the front door or opening or closing of the garage door.  DX Daily Store is not responsible for any maintenance or support for an Existing Product.  You expressly relieve DX Daily Store from any and all liability arising from your use of any Existing Product or Existing Product services. You may also be able to use the Grocery Box with the InHome Service. If using the Grocery Box, you acknowledge that the Delivery Personnel will unlock/lock the Grocery Box and that deliveries will be made into the Grocery Box by Delivery Personnel outside your home. You acknowledge and agree that there will not be a recording of deliveries.

     4.3    Other Occupants. You represent and warrant that you will make other occupants within the Home aware that the InHome Service will be performed and that Delivery Personnel are authorized to enter the Home. You are responsible for compliance with this Agreement by other occupants within the Home.  Delivery Personnel will not make deliveries or pick up returns if there is a minor present in the Home with no adult present.

     4.4     Pets.  Delivery Personnel will not make deliveries or pick up returns if there are uncontained pets in the Home.

     4.5     InHome Return Pickup Service. Certain items purchased on and sold by dxdailystore.com can be returned with the InHome Service. Items which are not eligible for returns include food and fresh items items delivered via  InHome, items purchased on dxdailystore.com through third party retailers and large items. If you are unsure if your item is eligible contact Customer Support as outlined in Section 11.2.  To do a return via InHome, you must request a return via dxdailystore.com or the DX Daily Store App and select InHome delivery as the return method. The return will be automatically scheduled. You can make changes to your scheduled pickup time until the return has been picked up by InHome delivery personnel. InHome Delivery personnel will access your home in accordance with Section 4.2. Refunds will be processed to the original payment method within 24 hours of the item being picked up by the InHome Delivery personnel.

     4.6      Grocery Box. By selecting Grocery Box at registration as the location in which you would like your InHome deliveries to take place you expressely acknowledge and agree that the Delivery Personnel will deliver your orders into the Grocery Box placed outside of your home and that there will not be a recording of such deliveries (“Recordings”). The Delivery Personnel will unlock the Grocery Box, place the order inside the box and lock the Grocery Box. If your order cannot fit inside the box, it will be placed discreetly behind the box. You agree to retrieve items from the box within 12 hours to ensure cold chain compliance. DX Daily Store is not liable for any items left inside the box for more than 12 hours. 

5.     Information Provided by You; Recordings 

     51.     Information Provided by You and Delivery Personnel. If you place an order for an InHome delivery via dxdailystore.com or the DX Daily Store app  or schedule an InHome return pickup of products via dxdailystore.com or the DX Daily Store app, the information that you provide in connection with such order will be subject to the DX Daily Store Privacy Policy (available ).  The Companion Product Software and InHome Software provides DX Daily Store and third parties, such as the smart lock and garage door service providers, with information relating to your use and the performance of the InHome Services and the Companion Products, including use of the Companion Products outside your use for the InHome Service (“Technical Data”).  For example, such Technical Data may include information about the Companion Products and how they operate or occurrences of technical errors.  Additionally, the InHome Software may collect image, video, or other types of recordings collected by cameras worn by our Delivery Personnel while on your property or in your Home (“Delivery Data”). Delivery Data may be collected as follows: (i) when Delivery Personnel arrive at your Home to complete an InHome delivery or return pickup, the Delivery Personnel’s vest begins streaming and then they will unlock the smart lock or open the garage door; and (ii) the camera is designed to record video footage of the Delivery Personnel’s path within your Home, for the duration of the delivery or return pickup (i.e., recording will typically commence before the door is unlocked or the garage is opened and will typically stop when the door is locked and closed or the garage door is closed by the Delivery Personnel after the delivery), in accordance with Section 5.2 below. For Delivery Personnel safety and your safety, the Delivery Personnel will not stop the recorded video footage at any point during delivery.  You may view the Recordings of our Delivery Personnel taken by our Delivery Personnel’s camera either in real time or at a later time via the InHome App. You will not have the ability to speak to the Delivery Personnel via the In Home App once they are in the Home; however, at any time you may contact InHome Customer Support who will contact the Delivery Personnel as needed.

     5.2      Recordings. The InHome Software will be used to create Recordings of Delivery Data solely for use by Walmart.  Recordings are not shared with third parties, including providers of the Companion Products. DX Daily Store retains Recordings for seven days after they are captured during the delivery window by Delivery Personnel.  After the seven-day period, the Recordings are destroyed.  Unless prohibited by law, DX Daily Store may store, access and share Recordings only with its Affiliates to address special circumstances such as compliance obligations or to protect the safety, property, or rights of any party including Walmart.

     5.3     App Notifications. You may receive notifications via the InHome App related to InHome onboarding, your membership, the delivery of your grocery order,  the pickup of your return and the status (locked/unlocked) and state (offline/online/jammed/low-battery) of your WiFi Bridge and/or Companion Products. You understand and agree that the InHome App may not provide status or state on an Existing Product.  Additionally, we may send you notifications regarding the set up and operation of the WiFi Bridge and Companion Products

     5.4.     Phone Notifications.  You may receive phone calls from an InHome Delivery Personnel at the phone number listed in your Account. We only contact you regarding issues related to the delivery of your grocery orderpickup of your return, or if we encounter an issue regarding installation of the WiFi Bridge or Companion Products.

     5.5      Email Notifications. You may receive email notifications related to InHome onboarding, your membership, the delivery of your grocery order, the pickup of your return, or the status of your WiFi Bridge or Companion Products.

     5.6     Your Authorization. On behalf of yourself and the other occupants of the Home, you hereby authorize DX Daily Store to create, collect, record, retain and destroy the Delivery Data, use and share the Delivery Data in accordance with the terms of Section 5.2 herein, and to contact you to provide the InHome Service.  Additionally, you authorize DX Daily Store to create, collect and retain Technical Data and to share the Technical Data with third parties such as the smart lock provider, to support and improve the InHome Service or for other legitimate businesses purposes of DX Daily Store or such third party. You also represent and warrant that you have the authority to grant the foregoing authorizations on your own behalf and on behalf of all occupants of the Home.  You understand and agree that to use certain features of the Companion Products you may need to set up a separate account and that you are responsible for reviewing and agreeing to applicable terms and conditions of use, license limitations, and privacy policies of such parties.

6.    Code of Conduct. Due to the personalized nature of the InHome Services, you may, from time to time, personally interact with our Delivery Personnel on your property or in your Home.  You must comply with, and ensure that all occupants of your delivery location comply with, the following code of conduct (“Code of Conduct”):

The purpose of this Code of Conduct is simple: to ensure the safety, comfort and enjoyment of all involved.  Accordingly, you agree that neither you nor any occupant of your Home shall: (i) physically harm, threaten to harm, or intentionally or recklessly cause harm to our Delivery Personnel, or create or fail to eliminate any condition that endangers the health or safety of our Delivery Personnel (e.g., unreasonable clutter, uncontained animals or other obstacles); (ii) make or attempt any sexual advance or statement to our Delivery Personnel; (iii) threaten, harass, stalk, intimidate, or engage in any other aggressive or bullying behavior against our Delivery Personnel; (iv) use any vulgar or obscene language or otherwise engage in behavior that is likely to make others feel uncomfortable, embarrassed or offended; (v) engage in any behavior that discriminates against our Delivery Personnel because of the individual’s race, color, sex, age, national origin, handicap, sexual orientation or religion; or (vi) request our Delivery Personnel to perform any tasks other than performing the InHome Services described in this Agreement. Any violation of our Code of Conduct shall be deemed a material breach of these Terms of Use, and DX Daily Store may suspend or terminate your Account and/or access and use of the InHome Services.

7.     Installation. If you require installation services, after your Account is created, InHome personnel or a third party acting on Walmart’s behalf will deliver an InHome Kit to your Home on the date of your installation appointment. You must have, and are solely responsible for obtaining and maintaining, at your expense, an Internet connection in order to receive and use the InHome Service and to install and use the Wifi Bridge and Companion Products.  Installation of the Wifi Bridge and Companion Products will be completed by InHome or a third party on our behalf. Appointments for installation of Companion Products will be scheduled directly with InHome before you complete check-out for purchase of your InHome Kit . InHome personnel or a third party acting on Walmart’s behalf will determine in their sole discretion whether you are eligible to participate in the service at the installation appointment, as not all front doors or garage doors will be compatible with the Companion Products.

NEITHER DX Daily Store NOR ANY OF ITS AFFILIATES ARE LIABLE FOR ANY DEFECTS OR OTHER DAMAGE ASSOCIATED WITH THE INSTALLATION OF THE WIFI BRIDGE OR COMPANION PRODUCTS, OTHER THAN DEFECTS OR OTHER DAMAGE ASSOCIATED SOLELY WITH THE INSTALLATION OF THE WIFI BRIDGE OR COMPANION PRODUCTS COMPLETED BY DX Daily Store OR A THIRD PARTY ON OUR BEHALF; EXCEPT THAT NEITHER DX Daily Store NOR ANY OF ITS AFFILIATES WILL HAVE ANY LIABILITY WHERE THE INSTALLED WIFI BRIDGE OR COMPANION PRODUCTS HAVE BEEN MODIFIED OR COMBINED WITH ANY OTHER THIRD PARTY PRODUCT, WHERE SUCH DEFECT OR OTHER DAMAGE WOULD NOT HAVE ARISEN BUT FOR SUCH MODIFICATION OR COMBINATION. WITHOUT LIMITING THE FOREGOING, NEITHER DX Daily Store NOR ANY OF ITS AFFILIATES HAVE ANY RESPONSIBILITY OR LIABILITY FOR (I) ANY PRODUCTS NOT DEVELOPED OR MANUFACTURED BY OR FOR DX Daily Store OR ITS AFFILIATES, INCLUDING COMPANION PRODUCTS  ; OR (II) IF YOU CANCEL THE INHOME SERVICE, (A) THE MAINTENANCE, UPKEEP OR FUNCTION OF THE WIFI BRIDGE OR ANY OF THE COMPANION PRODUCTS RETAINED BY YOU; OR (B) ANY LIABILITY ARISING FROM YOUR CONTINUED USE OF THE COMPANION PRODUCTS, HOWEVER CAUSED

8.     Cancellation and Rescheduling.

     8.1     Cancellation of the Services.  You may cease your use of the InHome Services at any time by contacting InHome customer service at 1-800-WALMART (phone), or via your Account in the Walmart+ member section on dxdailystore.com or in the DX Daily Store App, at which time all further transmissions of Delivery Data will stop; however, DX Daily Store and its affiliates will be entitled to retain any Recordings obtained prior to the effective date of such cancellation for the period and circumstances stated in Section 5.2.  You may continue to use the WiFi Bridge and your Companion Products after cancellation of the InHome Service provided that DX Daily Store will not provide any support or maintenance of the WiFi Bridge or Companion Products after such cancellation.  For clarity, your continued use of the WiFi Bridge and Companion Products through the InHome App after termination will allow DX Daily Store to have access to Technical Data, including information about when you use the Companion Products to lock or unlock your smart lock or use your garage opener to open and close your garage, as applicable. If you cancel the InHome Service and do not want to continue to use the WiFi Bridge or Companion Products, you are responsible for uninstalling the Companion Products and WiFi Bridge at your sole expense.  DX Daily Store has no liability for damages occurring during or after your removal of the WiFi Bridge or the Companion Products, or for your reinstallation of any device previously used to lock your Home or open your garage door prior to starting the InHome Service.  Continued use of the WiFi Bridge and Companion Products after cancellation is at your own risk and neither DX Daily Store or its Affiliates shall have any liability for such continued use of the Companion Products or WiFi Bridge. 

     8.2     Cancellation of an Order by an Associate.  Delivery Personnel may cancel a delivery or return pickup if, using their sole discretion: they feel unsafe in the Home, there is an uncontained pet in the Home, or minors are present without an adult in the Home.   Additionally, Delivery Personnel may cancel an order or return pickup if they cannot access the property or the Home due to issues with the Companion Products, unreasonable obstacles for entering the Home, a non-disabled alarm system, or any double lock which blocks entry. Please see Section 4.2 above regarding disarming alarms and security systems.

9.      Liability.

     9.1      Indemnification. You agree to defend (at Walmart’s option), indemnify, and hold each of DX Daily Store and its Affiliates harmless from and against any and all liabilities, claims, damages, costs, and expenses, including attorneys’ fees and costs, arising from or related to your misuse of the InHome Service or any breach by you of the Agreement. We and our Affiliates reserve the right, in our sole discretion and at our expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you and, in any case, you agree to cooperate with us if and as requested by us (or one of our affiliates, as applicable) in the defense and settlement of such matter.

     9.2     Damages to your property. Delivery Personnel are insured to provide you with peace of mind for each delivery. If your property was damaged as a direct result of the delivery or return pickup we will work with you to correct the problem. Contact customer service by phone at 1-800-WALMART  and we will work quickly towards a resolution. 

     9.3     Disclaimers. WITHOUT LIMITATION OF ANYTHING CONTAINED IN THE dxdailystore.com TERMS OF USE (AVAILABLE HERE), THE INHOME SERVICE, AND ALL CONTENT, MATERIALS, PRODUCTS REQUESTED BY OR DELIVERED TO YOU, SERVICES, FUNCTIONALITY, AND OTHER ITEMS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE INHOME SERVICE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  NEITHER DX Daily Store NOR ANY OF ITS AFFILIATES MAKES ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE QUALITY, OPERATION OR PERFORMANCE OF THE INHOME SERVICE, OR THE CONTENT, MATERIALS, PRODUCTS, SERVICES, FUNCTIONALITY, OR OTHER ITEMS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE INHOME SERVICES.  TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, DX Daily Store AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF TITLE, QUALITY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

     9.4      Limitation of Liability. The liability of DX Daily Store and its Affiliates will be limited in accordance with the ‘Limitation of Liability’ section of the dxdailystore.com Terms of Use (available here).

10.     Fees and Billing

     10.1            With respect to delivery charges, DX Daily Store offers a monthly and annual delivery subscription which is offered as an add-on (Plus Up) to the Walmart+ membership. DX Daily Store will automatically charge the credit card that we have on file for you the price displayed at the time of subscription selection (or a different price, if we have obtained your consent), plus any applicable taxes, on a recurring monthly or annual basis without further notice to you, until you cancel the subscription.  To avoid charges for a new monthly or annual term, you must cancel before the end of the current monthly or annual term. 

     To cancel, contact Customer Service by phone at 1-800-WALMART or cancel via your Account in the Walmart+ member section on dxdailystore.com or in the DX Daily Store App.  There are no refunds on delivery subscription charges.  If you cancel, you will be entitled to the subscription for the remainder of the month or year for which you have already paid.  Delivery subscriptions are subject to the terms displayed at the time of subscription selection, which may include, for example, minimum order requirements. 

     10.2           Customers are eligible for only one free trial for any membership including W+ and InHome. If a customer has used their free trial with W+, they will not get the free trial for InHome.

     11. General.

     11.1     Geographic Restrictions. Currently, the InHome Service is only available in limited zip codes (go to www.inhome.dxdailystore.com to find out if the InHome Service will be available in your area). If you do not live in such locations, you will not be able to use the InHome Service.

     11.2     Contact Information. For help with the InHome Services or resolving other issues, please contact Customer Service by phone at 1-800-WALMART.

     11.3     Refunds and Replacements of Goods ordered via InHome Service. While we strive to provide your first choice of products, occasionally we may have to offer substitute products.  We will notify you of substitutions made to your order via the DX Daily Store app before your order is packaged for delivery.  You can reject any unwanted substitutions by clicking “Don’t deliver this” in the InHome app and you will be refunded for the rejected items.  After delivery of your order, you may seek to obtain a refund or replacement for any product, including substituted products. Any refunds and replacements, including of substituted products, will be governed in accordance with the dxdailystore.com Terms of Use (available here), including the DX Daily Store Online Grocery Services terms set forth therein.
